Just curious, which validator did you use? 
Ran the theme through  http://validator.w3.org/ 
which is recommended on the 
http://codex.wordpress.org/Theme_Review page and it didn't catch it.

-I ran it trough w3 aswell but it has to be a page where the condition is false (comments disabled)
